CANADIAN PRIVACY POLICY LAW

Canadian private sector privacy legislation requires organizations to build privacy policies that outline how they collect, use and disclose their customers’ personal information. The Personal Information Protection and Electronic Documents Act (PIPEDA) sets the ground rules for how private-sector organizations collect, use, and disclose personal information in the course of for-profit, commercial activities across Canada.

How PIPEDA applies to charitable and non-profit organizations

Non-profit organizations are usually not subject to the Personal Information Protection and Electronic Documents Act (PIPEDA ) because they do not typically engage in commercial activities. This includes most charities, minor hockey associations, clubs, community groups and advocacy groups, for example. The following activities are not considered commercial and are not subject to PIPEDA:

• collecting membership fees
• organizing club activities
• compiling a list of members' names and addresses
• mailing out newsletters
• fundraising

PIPEDA applies to organizations that collect, use or disclose personal information in the course of commercial activities. Commercial activity is the most important consideration in determining if the Act applies to the organization. PIPEDA defines commercial activity as:

"…any particular transaction, act or conduct or any regular course of conduct that is of a commercial character, including the selling, bartering or leasing of donor, membership or other fundraising lists."

You can always refuse to supply personally identification information, but it may prevent you from engaging in certain website related activities.

• To process membership applications and administer memberships

• To improve service; respond to your service request and support your needs
• To tailor services to meet individual preferences – We may use information in the aggregate to understand how our users as a group use the services and resources provided on our website.
• To improve our website – We may use feedback you provide to improve our web site and services.
• To process payments – We may use the information you provide about yourself when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.
• To administer surveys, contests, promotions or other features – To send information you agreed to receive about topics we think will be of interest to you.
